1. Agreement and scope／同意及適用範圍
By accessing AcornSync, you agree to these Terms, the Privacy Policy and any school or subscription agreement that applies to your account. Schools must ensure authorised staff, parents and guardians are informed of applicable policies. 使用 AcornSync 即表示你同意本條款、私隱政策，以及適用於你帳戶嘅學校或訂購協議。
2. Roles and responsibility／角色及責任
The school decides the purposes for which school records, student information, photographs, reports and communications are entered and shared. The school is responsible for lawful authority, notices, consents, access decisions, record accuracy and safeguarding procedures. AcornSync operates the platform and processes information according to authorised instructions, subject to applicable law and contractual commitments. 學校負責決定學生資料、相片、報告及通訊嘅收集、使用及分享目的，並負責取得所需授權、通知或同意、核實資料準確性、分配權限及執行兒童保障程序。
3. Account security／帳戶保安
Users must protect passwords and devices, use only their own account, enable available security controls, and notify the school or AcornSync promptly of suspected unauthorised access. Account holders are responsible for activity performed through their account unless caused by a platform security failure. 用戶必須妥善保管密碼及裝置，不得共用帳戶，並在懷疑帳戶被盜用時立即通知學校或 AcornSync。
4. Student data, photographs and content／學生資料、相片及內容
A user must not upload or publish content unless the school has lawful authority and any required consent. The school must check audience, class access and website visibility before publication. Public website publishing is separate from private family access; selecting public publishing means the content may be viewed, copied or indexed by anyone. 用戶只可上載已獲合法授權及所需同意嘅內容。學校發佈前須核對對象、班別權限及官網公開設定；公開內容可能被任何人瀏覽、複製或搜尋器收錄。
5. AI-assisted features／AI 輔助功能
AI output is a drafting aid and may be inaccurate, incomplete, biased or unsuitable. Authorised staff must review, edit and approve every output before relying on or sharing it. AI must not be the sole basis for safeguarding, admission, assessment, disciplinary, medical or other decisions with significant effects on a child. Do not submit unnecessary sensitive data to an AI feature. AI 內容只供草擬，可能出錯、不完整或帶有偏差；職員必須人手覆核。不得單憑 AI 作出對兒童有重大影響嘅保障、收生、評估、紀律或醫療決定。
6. Acceptable use／可接受使用
Users must not access another school or child without authority; upload unlawful, harmful, defamatory, infringing or malicious material; harass or impersonate others; bypass access controls; probe security; introduce malware; scrape the service; overload infrastructure; reverse engineer protected components; or use the service to advertise to children. 用戶不得未經授權存取其他學校或學生資料、繞過權限、測試或破壞保安、散播惡意程式、冒認或騷擾他人、侵犯知識產權、批量擷取資料或利用平台向兒童推廣。
7. School administration and exports／學校管理及備份
Schools must promptly remove departed staff, review class and family access, maintain suitable internal records and export information required for continuity or legal retention. AcornSync is not the school’s sole safeguarding, emergency, attendance or statutory record system unless expressly agreed in writing. 學校須及時停用離職帳戶、定期覆核權限及按需要匯出紀錄。除非另有書面協議，AcornSync 並非學校唯一嘅緊急、保障、出席或法定存檔系統。
8. Availability and third-party services／服務及第三方系統
The service may depend on hosting, authentication, email, storage, mobile platform, AI and website providers. Maintenance, internet conditions and third-party failures may affect availability. We use reasonable care but do not promise uninterrupted or error-free service, and schools should maintain appropriate operational fallback procedures. 平台可能依賴雲端、登入、電郵、儲存、手機平台、AI 及網站供應商；學校應保留合適嘅後備工作流程。
9. Suspension and removal／暫停及移除
Access may be restricted or suspended to protect users, investigate security or legal concerns, prevent misuse, respond to non-payment, or comply with law. Where practicable, the school will be notified and given an opportunity to address the issue. 為保障用戶、調查保安或法律問題、防止濫用、處理欠款或遵守法律，AcornSync 可限制或暫停服務。
10. Intellectual property／知識產權
Schools and users retain rights they lawfully hold in uploaded content and grant the service operator a limited licence to host, process, transform and deliver that content only to operate the service. AcornSync software, branding and documentation remain protected and may not be copied or resold without permission. 學校及用戶保留其合法擁有嘅內容權利，並授予平台為提供服務所需嘅有限處理權；AcornSync 軟件、品牌及文件不得未經授權複製或轉售。
11. Warranties, liability and indemnity／保證、責任限制及彌償
To the fullest extent permitted by law, the service is provided with reasonable care but without guarantees that every feature or generated output will meet a particular purpose. The operator is not liable for indirect, consequential, special or loss-of-profit damages arising from user content, incorrect settings, unauthorised instructions, third-party failures or decisions made without required human review. Subject to liabilities that cannot lawfully be excluded, aggregate liability is limited to fees paid for the affected service during the 12 months before the event. A school will be responsible for, and will indemnify the operator against, third-party claims caused by the school’s unlawful content, missing authority or consent, misuse, or material breach of these Terms, except to the extent caused by the operator’s breach, negligence, fraud or wilful misconduct. 在法律容許嘅最大範圍內，平台不承擔因錯誤設定、未獲授權內容、第三方故障或缺乏人手覆核而引致嘅間接或相應損失；任何依法不得排除嘅責任不受本條限制。
12. Governing law and changes／適用法律及修訂
These Terms are governed by the laws of the Hong Kong Special Administrative Region, and disputes are subject to the jurisdiction of Hong Kong courts unless an applicable written agreement provides otherwise. Material changes will be notified through the service or the school where reasonably practicable. 本條款受香港特別行政區法律管限；重大修訂會在合理可行情況下透過平台或學校通知。
